Agreement to Terms

These Terms and Conditions ("Terms") govern your use of the Evergreen Freight Transport Inc website and services. By accessing or using our services, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you may not use our services.

Services

Evergreen Freight Transport Inc provides transportation and logistics services, including but not limited to:

Truckload hauling services
Refrigerated transportation
Contract carrier services
Flatbed hauling
Third-party logistics (3PL) services

Service Agreements

Quotes and Pricing

All quotes provided are estimates based on the information provided by the customer. Final pricing may vary based on actual shipment details, weight, dimensions, and route conditions. Quotes are valid for 30 days unless otherwise specified.

Booking and Confirmation

Services must be booked in advance. A confirmation will be provided once your booking is accepted. We reserve the right to refuse service at our discretion.

Customer Responsibilities

As a customer, you agree to:

Provide accurate and complete information about shipments
Ensure cargo is properly packaged and labeled
Comply with all applicable laws and regulations
Provide necessary documentation (bills of lading, permits, etc.)
Make payment according to agreed terms
Ensure cargo is ready for pickup at scheduled times

Payment Terms

Payment terms are as follows:

Payment is due upon completion of service unless credit terms have been established
Approved credit accounts have Net 30 payment terms
Late payments may incur interest charges of 1.5% per month
We accept various payment methods including wire transfer, ACH, and credit cards
A service fee may apply to credit card payments

Liability and Insurance

Cargo Insurance

Evergreen Freight Transport Inc maintains cargo insurance as required by federal regulations. Our liability is limited to $100,000 per shipment unless additional coverage is purchased. Customers are encouraged to obtain additional insurance for high-value cargo.

Limitation of Liability

Our liability for loss, damage, or delay is limited to the actual value of the goods or the amount specified in our insurance coverage, whichever is less. We are not liable for consequential, indirect, or special damages.

Claims

All claims for loss or damage must be filed in writing within 9 months of delivery or scheduled delivery date. Claims must include supporting documentation such as bills of lading, invoices, and evidence of damage.

Prohibited Items

We do not transport the following items without prior approval and proper documentation:

Hazardous materials (without proper permits and documentation)
Illegal substances or contraband
Perishable goods (without refrigerated service)
Live animals (without specialized arrangements)
Items prohibited by federal, state, or local law

Cancellation and Rescheduling

Cancellation and rescheduling policies:

Cancellations must be made at least 24 hours before scheduled pickup
Late cancellations may incur a cancellation fee
Rescheduling requests should be made as early as possible
We reserve the right to cancel service due to weather, safety concerns, or other unforeseen circumstances

SMS Communications

By providing your phone number and consenting to SMS communications, you agree to receive text messages from Evergreen Freight Transport Inc regarding your shipments and service updates. You may opt-out at any time by replying STOP. Reply HELP for assistance at +1 (909) 960-0311. Message and data rates may apply. Message frequency varies.

Compliance with Laws

All services are provided in compliance with federal, state, and local regulations, including but not limited to Department of Transportation (DOT) regulations, Federal Motor Carrier Safety Administration (FMCSA) rules, and applicable state transportation laws.

Intellectual Property

All content on this website, including text, graphics, logos, and images, is the property of Evergreen Freight Transport Inc and protected by copyright and trademark laws. You may not use, reproduce, or distribute any content without our written permission.

Dispute Resolution

Any disputes arising from these Terms or our services shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall take place in California, and the decision shall be final and binding.

Indemnification

You agree to indemnify and hold harmless Evergreen Freight Transport Inc from any claims, damages, or expenses arising from your use of our services, violation of these Terms, or violation of any rights of another party.

Force Majeure

We are not liable for delays or failures in performance resulting from circumstances beyond our reasonable control, including but not limited to acts of God, weather conditions, natural disasters, strikes, government actions, or equipment failures.

Modifications to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to our website. Your continued use of our services after changes are posted constitutes acceptance of the modified Terms.

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

Entire Agreement
